These terms and conditions apply to the Haps app (hereby referred to as "Application") for mobile devices that was created by haps events (hereby referred to as "Service Provider") as a Free service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.
You must be at least 13 years old (or the minimum digital consent age in your country, whichever is higher) to create an account. Certain features — including 18+ events, age-restricted venues, ticket purchases, and the ticket marketplace — require you to be 18 or older and may require age or identity verification.
You confirm that the date of birth and identity information you provide is accurate. Providing false age information is a breach of these terms and may result in immediate removal of access, cancellation of tickets, and forfeiture of any associated entitlements.
You are responsible for all activity that occurs under your account, for keeping your login credentials confidential, and for the accuracy of the information on your profile. You may not share, sell, rent, or transfer your account, impersonate another person or organisation, or create an account on behalf of someone else without authorisation.
If your account has been suspended or removed, you may not create or operate a replacement account. We use automated and manual signals — including device and behavioural signals — to detect circumvention, and accounts identified as evading enforcement (and any groups or events they control) may be restricted, frozen, or removed without further notice.
You retain ownership of the photos, videos, stories, posts, comments, memos, reviews, event listings, group content, and other material you submit ("User Content"). By submitting User Content, you grant the Service Provider a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, cache, reproduce, adapt (for formatting, compression, cropping and thumbnailing), publish, publicly display, and distribute that User Content for the purposes of operating, promoting, and improving the Application and its features.
This licence continues for as long as your content remains on the platform and for a reasonable period afterwards to allow for backups, caching, moderation records, and legal compliance. Content you have shared with others, or that others have re-shared, may remain visible to them after you delete your copy.
You warrant that you own or have all necessary rights to your User Content, including rights to any music, imagery, logos, artwork, and to the likeness of any identifiable person appearing in it, and that it does not infringe any third-party rights or breach any law.
You agree not to post, send, host, organise, or promote content or events that:
Reports are reviewed by a combination of automated systems and human moderators. We may, at our sole discretion and without prior notice, remove or blur content, restrict features, place content behind a warning, withdraw a group's verified status, freeze groups, cancel events and associated tickets, issue warnings, or suspend or permanently ban accounts. Where practical we will tell you what happened and, where offered, you may submit an appeal in-app.
Events on the Application are created and controlled by users and organisers, not by the Service Provider. We are a discovery and ticketing platform — we are not the promoter, producer, venue, or organiser of any event, and we do not verify the accuracy of event details, safety of a venue, or suitability of any attendee.
If you organise an event, you are solely responsible for: the accuracy of your listing, all required licences, permits, insurance and safety measures, compliance with venue rules and local law (including alcohol, noise, capacity, and age restrictions), honouring the tickets you sell, handling attendee data lawfully, and responding to refund requests. Verified status, where granted, reflects a lightweight identity/quality check only and is not an endorsement or a guarantee.
If you attend an event, you do so at your own risk. Meeting people from the internet in person carries risk. Use your judgement, share your plans with someone you trust, and never rely on the Application as a safety, security, or emergency service.
Payments are processed by Stripe. We do not store your full card details. By purchasing, you also agree to Stripe's terms. Ticket prices, booking fees, and platform fees are disclosed before you confirm, and include GST where applicable. Tickets are a revocable licence to attend, remain the property of the issuing organiser, and may be voided if obtained fraudulently, transferred outside the Application, duplicated, or used in breach of these terms.
QR ticket codes are single-use and cryptographically signed. Attempting to reproduce, share, tamper with, or resell a scanned or invalidated ticket is fraud and may be reported to the organiser, the venue, and law enforcement.
Tickets may go on sale at a time set by the organiser and are sold subject to capacity. Starting a checkout places a short, temporary hold on the inventory you selected; if you do not complete payment before the hold lapses, those tickets are released to other buyers. A hold is not a guarantee of purchase, and adding a ticket to a checkout does not reserve it indefinitely.
Where an event is sold out you may be able to join a waitlist; a waitlist place is not a ticket and does not guarantee availability. Promo and discount codes are created by organisers, are subject to their own usage limits and expiry, may be withdrawn at any time, cannot be combined unless stated, and have no cash value. We may void an order where a code was obtained or used improperly. Using bots, scripts, or automated tooling to buy, hold, or scalp tickets is prohibited.
Selling tickets through the Application requires approval and may require verification of your identity, your group, or your event. We may decline, pause, or withdraw ticketing access, and may revoke verified status, where we reasonably believe an organiser cannot deliver the event, has breached these terms, or presents a risk to buyers.
Ticket revenue is collected via Stripe and released to the organiser net of platform and processing fees, subject to any hold period, dispute, chargeback, or refund reserve we reasonably apply to protect buyers. Organisers remain responsible for their own tax obligations, including GST, and for issuing anything required by law to their attendees.
Where you access the Organiser Portal or its API, you must keep your credentials and API keys confidential, use them only for your own events, and not scrape, resell, or bulk-export attendee data. Attendee information you receive is provided solely to run that event and to satisfy legal obligations — you are an independent controller of it, must handle it in line with applicable privacy law and our Privacy Policy, must not add attendees to unrelated marketing, and must delete it when it is no longer needed. Misuse of attendee data is a material breach of these terms.
Attendance may be confirmed by a door scan or, where you have granted location permission, by your device being near the venue. These signals unlock features such as post-event reviews and are recorded against your account and shared with the organiser of that event. Location and proximity detection are estimates and are not a substitute for the organiser's own entry process; presence detected by the Application does not entitle you to entry, and entry decisions remain with the organiser and venue.
Reviews may only be left for events you actually attended, and must be honest, first-hand, and free of abuse, personal information, or content that breaches the Community Guidelines. Buying, selling, incentivising, exchanging, or coercing reviews — and posting reviews of your own events — is prohibited. Ratings are aggregated into an internal quality score for the organising group; we may remove reviews that breach these terms and may discount ratings we reasonably believe to be manipulated. Reviews reflect the opinions of users, not the Service Provider.
Issues about a ticket or an event are raised as a case handled first by the event organiser or their authorised staff, who may respond under a staff display name. If the organiser does not respond within a reasonable period, the case may be escalated to us — automatically or at your request. Escalation means we will review the case and may act on the ticket or the organiser's access; it does not oblige us to fund a refund the organiser is responsible for. Abusing the case system — spam, threats, or knowingly false claims — may result in loss of access.
Groups are run by their owners and the staff they appoint. Group staff may approve or remove members, moderate discussions, pin, lock or delete topics, restrict who may post, broadcast announcements to members, and scan tickets for that group's events. Staff act on behalf of the group, not the Service Provider, and must apply these terms and the Community Guidelines. Invite links may be revoked or expire, and private group content must not be copied or republished outside the group without permission. We may freeze or remove a group, revoke its verification, and pull back its unpublished events where it or its owner breaches these terms.
We record first-party usage analytics — screens viewed, time on screen, the labels of controls you tap, and content views — to operate, measure, and improve the Application, and we make aggregated performance data available to organisers for their own events. This is described in detail in our Privacy Policy. With your permission we send push notifications and emails for reminders, social activity, and ticketing. You may switch off notification types in the app or revoke permission on your device; transactional messages relating to your tickets, payments, safety, and account will still be sent.
Map positions, distances, routes, travel times, weather, and check-in radii are estimates provided with the help of third-party data and may be inaccurate, delayed, or unavailable. Never rely on them for navigation, timing, or safety-critical decisions.
Direct messages, group chats, forums, and stories are provided as-is. Messages are not end-to-end encrypted and may be reviewed where necessary for safety, moderation, or legal compliance. Do not use these features to transmit sensitive personal, financial, or health information.
Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device.
Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.
Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges.
By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.
In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.
The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application.
The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you.
The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.
This policy applies to all tickets purchased through the Application. Nothing in this policy limits your rights under the Australian Consumer Law.
All ticket prices are shown upfront, including any booking fees, before you confirm your purchase. Prices include GST where applicable.
To keep tickets fair and accessible, the following rules apply to all ticket resales on the platform:
The Application relies on third-party services including Base44 / Wix.com Ltd (hosting, database, AI features), Stripe (payments), Google and OpenStreetMap/CARTO (map imagery and geocoding), weather data providers, and push notification services provided by Apple and Google. Their availability, accuracy, and terms are outside our control, and we are not liable for their acts or omissions.
If you believe content on the Application infringes your intellectual property, email us with a description of the work, the location of the content in the app, your contact details, and a statement that you hold the rights and are acting in good faith. We will investigate and may remove the content and take action against repeat infringers.
To the maximum extent permitted by law, the Application is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant the conduct of any user, organiser, venue, or attendee.
To the maximum extent permitted by law, the Service Provider will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary loss, or for loss of profits, data, goodwill, or opportunity, arising from or relating to your use of the Application, any event you attend or organise, any interaction with another user, any unauthorised access to your account, or any inaccurate content or data.
Where liability cannot be excluded, our total aggregate liability is limited to the greater of (a) the total fees you paid to us through the Application in the 12 months before the claim, or (b) AUD $100. Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other applicable mandatory consumer law.
You agree to indemnify and hold harmless the Service Provider and its officers, contractors, and service providers from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your User Content, your events, your breach of these terms or any law, or any dispute between you and another user, organiser, or attendee.
You may stop using the Application and delete your account at any time via Settings → Account Actions → Delete Account. We may suspend or terminate your access, with or without notice, if you breach these terms, if required by law, or to protect users or the integrity of the platform. Provisions relating to User Content licences, disclaimers, liability limits, indemnity, and governing law survive termination.
If you obtained the Application from the Apple App Store or Google Play, you also agree to that store's terms. Apple and Google are not parties to these terms, have no obligation to provide support or maintenance for the Application, and Apple is a third-party beneficiary entitled to enforce these terms against you. Any claim relating to the Application is with the Service Provider, not the app store.
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. Before commencing formal proceedings, you agree to contact us and attempt to resolve the dispute informally in good faith for at least 30 days. If any provision is found unenforceable, the remainder continues in force. Our failure to enforce a provision is not a waiver of it. We may assign these terms in connection with a merger, acquisition, or sale of assets.
The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
